Kenya’s Ombudsman’s petition challenging the eligibility of the Member of Parliament for a Nairobi Constituency, to serve in public office will proceed to a full hearing. A High Court in Nairobi dismissed an application by the Independent Electoral and Boundaries Commission (IEBC) of Kenya to have the matter quashed, on grounds of non-compliance with procedures provided for under the Elections Act of 2011 that required elections petitions to be filed within 28 days of the announcement of results.
Mr. John Ndirangu Kariuki, is among 27 individuals the Ombudsman found found culpable of malfeasance and, therefore, unsuitable to hold public office. Mr. Ndirangu had been convicted of abuse of office while serving as the Mayor of Nairobi. However, he was cleared by the Independent Electoral and Boundaries Commission (IEBC) of Kenya, the recommendation from the Ombudsman seeking to bar him from contesting the 2013 Elections notwithstanding.
