In the performance of duties under section 230-231 of the Constitution of the Kingdom of Thailand, the Ombudsman of Thailand may refer a matter together with an opinion to the Constitutional Court upon making a finding where any provision of law begs the question of the constitutionality.
Similarly, the Ombudsman may refer a matter together with an opinion to the Administrative Court where a rule, order or any other act of a state agency or a state official begs the question of the constitutionality or legality.
Thus, the Memoranda of Understanding (MoU) signed between the Ombudsman and the Constitutional Court, and between the Ombudsman and the Administrative Court will nurture collaboration in various areas and therefore benefit the aforementioned agencies in fulfilling their duties. The collaboration between the Office of the Ombudsman and the Constitutional Court, as well as the Administrative Court will enhance operational alignment and conformity to undertake duties effectively for the benefit of the country and the people.
